The Mediation Precedent Analysis of Medical Dispute and Improvement

Abstract
Objective: The purposes of this study were to analysis the dental dispute cases and to provide the resolution of in Korea Medical Dispute Mediation.

Methods: Literature review of dental medical accident and prevention plans were carried out through website of National Theather of Korea, PubMed, Korea Citation Index, Riss4u, and Korea Consumer Agency.

Results: Results of the dental dispute mediation indicated that dismissal due to non-agreement in participation by the dentist was 50.8%, and the agreement of mediation was 23.9%, non-mediation by no fault of the dentist was 5.7%, and agreement on mediation decision was 1.95%. It was determined that mediation agreement was in 23.9% of cases, the decision on mediation was in 5.3% of cases, and the agreement among the initiated cases of mediation, excluding dismissed, withdrawn, and ongoing cases was in 67.7% of cases (63 cases), and the decision on mediation was in 15.1% of cases (14 cases).

Conclusion: Medical malpractice has occurred prior to the treatment plan, including the description of the patient in order to prevent disputes sparked by medical, communication, trust, etc. are needed and how to ensure that disputes are resolved through adjustments or medical dispute resolution institutions, rather than litigation Suggest how this agreement that benefit both patients and health professionals.
